Stadium Capital Qualified Partners, L.P. v. Cerberus ABP Investor LLC, C.A. No. 5707-VCL (2010)

Seitz Ross attorneys represented plaintiff Stadium Capital, the largest public minority shareholder of BlueLinx Holdings Inc., in challenging Cerberus Capital Management, L.P.’s attempt to effect a $49.6 million freeze-out of BlueLinx.  Cerberus allowed its tender offer to expire in October 2010 after the conditions to that offer were not satisfied.
